Welcome to SideroCloud (“Company”, “we”, “our”, “us”). These Terms of Service (“Terms”) govern your access to and use of our hosting services, including game servers, VPS hosting, and related tools (collectively, the “Services”). By accessing or using the Services, you agree to these Terms. If you do not agree, do not use our Services.

1. Eligibility

You must be at least 18 years old or the legal age of majority in your jurisdiction to create an account and purchase Services.

If you are using our Services on behalf of a company or group, you represent that you are authorized to do so.

2. Account Registration & Security

  • You must provide accurate and up-to-date information when creating an account.
  • You are responsible for maintaining the confidentiality of your account credentials and any activity under your account.
  • Sharing accounts or reselling access to our Services without permission is strictly prohibited.

3. Acceptable Use Policy

You agree to use our Services only for lawful purposes and in accordance with these Terms. Prohibited activities include, but are not limited to:

  • Hosting or distributing malware, phishing tools, or illegal content.
  • Engaging in DDoS attacks, network abuse, or activities that disrupt our infrastructure or other customers.
  • Running unauthorized resource-intensive scripts that harm server performance.
  • Using our Services for spamming, crypto-mining (unless explicitly allowed), or piracy-related content.

We reserve the right to suspend or terminate accounts that violate these rules.

4. Service Availability & Performance

We aim to maintain high availability of our hosting infrastructure. However, we do not guarantee uninterrupted access, as downtime may occur due to maintenance, upgrades, or unforeseen technical issues.

For VPS and game server plans, resource allocations (RAM, CPU, bandwidth) are based on the purchased plan. Exceeding these limits may result in throttling or suspension.

5. Data & Backups

  • You are responsible for maintaining your own backups of data hosted on our Services.
  • We may provide automated backup solutions, but we do not guarantee data recovery in the event of loss or corruption.

6. Payments & Billing

  • All fees for Services are due in advance unless otherwise stated.
  • Late payments may result in suspension or termination of your Services.
  • Fees are based on your chosen plan and usage.

6A. Refund & Cancellation Policy

Refund Eligibility

All payments made to SideroCloud are generally non-refundable. A refund may only be considered where the customer provides a legitimate and verifiable reason, and the request is reviewed and approved solely at the discretion of SideroCloud.

Submitting a refund request does not guarantee approval. SideroCloud reserves the absolute right to approve or deny any refund request based on the circumstances presented, service usage, account standing, and compliance with these Terms.

  • Renewals
  • Partial billing periods
  • Domain registrations
  • Dedicated IPs
  • Setup fees
  • One-time add-ons
  • Custom work or service-specific setup
  • Services suspended or terminated due to violation of these Terms or our Acceptable Use Policy

Cancellation

  • You may request cancellation of your Services at any time via your account dashboard.
  • All cancellations will only take effect at the end of the current active billing term.
  • No mid-term cancellations, prorated refunds, service credits, or partial reimbursements will be issued for unused time remaining in the current billing cycle.
  • Once a cancellation request is submitted, the Service will remain active until the end of the paid billing term and will not renew for the next billing cycle.

Disputed Payments

Any chargeback, payment reversal, or dispute initiated without first contacting us for resolution may result in immediate suspension or permanent termination of the associated account and Services.

We reserve the right to recover any outstanding balances, fees, costs, or losses arising from disputed payments to the extent permitted by law.

7. Content Ownership & Responsibility

  • You retain ownership of any content you host on our servers.
  • You are solely responsible for ensuring that your content complies with applicable laws and does not infringe on third-party rights.

8. Third-Party Software & Licenses

Some Services may require you to use licensed software (e.g., Minecraft server software). You are responsible for ensuring you hold proper licenses where required.

We are not responsible for the security or legality of any third-party software you upload or install on our servers.

9. Termination

We may suspend or terminate your account if you:

  • Fail to pay for Services,
  • Violate these Terms or our Acceptable Use Policy, or
  • Engage in behavior that poses a security risk to our systems or customers.

You may request cancellation of your Services at any time through your account dashboard, subject to the cancellation terms stated in Section 6A.

10. Disclaimers

Our Services are provided “as is” and “as available” without any warranties, express or implied. We do not guarantee uptime, speed, or suitability for any particular purpose.

11. Limitation of Liability

To the maximum extent permitted by law, we are not liable for any indirect, incidental, or consequential damages, including but not limited to loss of data, downtime, or lost profits.

12. Indemnification

You agree to indemnify and hold SideroCloud harmless from any claims, damages, or expenses resulting from your use of the Services, including violations of these Terms.

13. Changes to Terms

We may update these Terms at any time. The updated Terms will take effect upon posting. Continued use of the Services constitutes acceptance of the new Terms.

14. Governing Law

These Terms are governed by the laws of India (Kerala jurisdiction), without regard to its conflict of law principles.
